That's the minimum, since below that you're going to get very low download speeds as all peers will consider you a very poor trading partner. If you're not willing or do not have the possibility to upload, you should turn to other technologies such as Usenet or HTTP/FTP downloads and quit BitTorrent, since BitTorrent NEEDS you to upload in order to be able to download.
